Barnes SP-98-151 2 <br /> FINDINGS <br /> General Findiniz <br /> 1. the subject property is located at 3 Bight Circle and consists of 20,882 square <br /> feet fronting on Popponesset Creek. <br /> Special Permit Criteria <br /> Section 174-25.1.9 states that the Board must find that the structure will not <br /> unduly interfere with the free passage of travel by water or land or cause or contribute to <br /> the substantial disruption or degradation on the marine or coastal environment. <br /> Specific Finding <br /> I. the proposed dock will be an accessory to an existing dwelling and is a <br /> permissible use upon the grant of a Special Permit. <br /> 2. the proposal has been approved by the Shellfish Constable whose <br /> responsibilities include safety on the water and protection of the marine <br /> environment. <br /> 3. the proposal has been approved by the Conservation Commission to address <br /> impacts on the coastal environment. <br /> 4. the use is in harmony with the general purpose and intent of the By-laws. <br /> 5. rights to maintenance in perpetuity. <br /> In view of the foregoing, the Mashpee Board of Appeals found that the applicant <br /> met the criteria necessary for the granting of a Special Permit. Upon motion duty made <br /> and seconded, the Board of Appeals voted unanimously on December 9, 1998 to grant the <br /> Special Permit, subject to the following conditions: <br /> I. compliance with License Plan No. 2584, dated October 26, 1990. <br /> 2. the dock shall be installed within the three-foot contour line. <br /> 3. the float size shall be reduced to 8 feet x 16 feet. <br /> 4. the westerly side of the float shall be installed at elevation three. <br /> 5. the length of the dock shall be reduced to approximately 38 feet from the <br /> mean high water line. <br />
