Inc. Sp-97-07 <br /> A Petition was filed by Deer Crossing Associates- Italian Market - L.L. R.C., Inc. <br /> on December 10, 1996 for a Special Permit under Sections 174-5 IB, 174-25.E.2, 174- <br /> 25.11.6 and 174-17 to allow two signs exceeding 20 square feet each, continued use of a <br /> pre-existing sign, a sign less than 20 square feet on the back wall, a menu board and an <br /> awning over a drive-through window. The applicant also requests a Special Permit to <br /> operate a drive-through window for food and beverage service on property located in a C- <br /> I zoning district at 681 Falmouth Road (Map 81, Block 23) Mashpee, MA. <br /> Notice was duly given to abutters in accordance with Massachusetts General Laws <br /> Chapter 40A. Notice was given by publication in The Mashpee Enterprise, a newspaper <br /> of general circulation in the Town of Mashpee, on December 20, 1996 and December 27, <br /> 1996, a copy of which is attached hereto and made a part hereof <br /> A Public Hearing was held on the Petition at the Carol H. Jacobson Senior Center <br /> on Wednesday, January 8, 1997 at which time the following members of the Board of <br /> Appeals were present and acting throughout: Edward M. Govoni, James E. Regan III and <br /> Robert G. Nelson. <br /> This Decision is issued by the Mashpee Board of Appeals pursuant to the <br /> provisions of Massachusetts General Law, Chapter 40A, Section 6 and Section 174-51.D <br /> of the Town of Mashpee Zoning By-laws. <br /> Attorney Robert Mills represented the applicant and requested to withdraw <br /> without prejudice the application for the sign on the back wall, a menu board, the drive <br /> through window and an awning over the drive through window. He informed the Board <br /> that the application was only for a Special Permit for two signs exceeding 20 square feet <br /> each. <br />
