Sp-97-07 A Petition was filed by Deer Crossing Associates- Italian Market - L.L. R.C., Inc. on December 10, 1996 for a Special Permit under Sections 174-5 IB, 174-25.E.2, 174- 25.11.6 and 174-17 to allow two signs exceeding 20 square feet each, continued use of a pre-existing sign, a sign less than 20 square feet on the back wall, a menu board and an awning over a drive-through window. The applicant also requests a Special Permit to operate a drive-through window for food and beverage service on property located in a C- I zoning district at 681 Falmouth Road (Map 81, Block 23) Mashpee, MA. Notice was duly given to abutters in accordance with Massachusetts General Laws Chapter 40A. Notice was given by publication in The Mashpee Enterprise, a newspaper of general circulation in the Town of Mashpee, on December 20, 1996 and December 27, 1996, a copy of which is attached hereto and made a part hereof A Public Hearing was held on the Petition at the Carol H. Jacobson Senior Center on Wednesday, January 8, 1997 at which time the following members of the Board of Appeals were present and acting throughout: Edward M. Govoni, James E. Regan III and Robert G. Nelson. This Decision is issued by the Mashpee Board of Appeals pursuant to the provisions of Massachusetts General Law, Chapter 40A, Section 6 and Section 174-51.D of the Town of Mashpee Zoning By-laws. Attorney Robert Mills represented the applicant and requested to withdraw without prejudice the application for the sign on the back wall, a menu board, the drive through window and an awning over the drive through window. He informed the Board that the application was only for a Special Permit for two signs exceeding 20 square feet each.
