Town of Mashpee <br /> �( 16 Great JVeck qtoad Arth <br /> BOARD OF APPEALS Mashpee, Massachusetts 02649 <br /> Decision for a Variance <br /> RE: Irene Realty Trust 24 East Way <br /> Map 89 Block 76 <br /> A Petition was filed on January 23, 1997 by Irene Realty Trust for a Variance from <br /> Section 174-31 of the Zoning By-laws for permission to vary the minimum lot frontage <br /> requirements in a cluster subdivision to allow construction of a single family dwelling on <br /> property located in an R-3 zoning district at 24 East Way(Map 89, Block 76)Mashpee, <br /> MA. (Owner of record: Midtown Realty Co.) <br /> Notice was duly given to abutters in accordance with Massachusetts <br /> General Laws Chapter 40A. Notice was given by publication in The Mashpee Enterprise, <br /> a newspaper of general circulation in the Town of Mashpee, on February 7, 1997 and <br /> February 14, 1997, a copy of which is attached hereto and made a part hereof. <br /> A Public Hearing was held on the Petition at the Mashpee Town Hall on <br /> Wednesday, February 26, 1997 at 7:30 P.M. at which time the following members of the <br /> Board of Appeals were present and acting throughout: Edward M. Govoni, James E. <br /> Regan III and Cheryl A. Hawver. <br /> This Decision is issued by the Mashpee Board of Appeals pursuant to the <br /> provisions of Massachusetts General Law, Chapter 40A, Section 10 and Section 174-31 <br /> of the Mashpee Zoning By-laws. <br /> Engineer John Slavinsky represented the applicant and informed the Board that the <br /> subject lot ran from East Way to River Road but that the owner wanted the proposed <br /> house to have access from East Way which is paved. He explained that the lot has 20 foot <br /> frontage on East Way but zoning requires 60 feet on a curve. One abutter questioned the <br /> need for a Variance and the Board received written correspondence in favor of the <br /> Variance from other abutters. Comments were received at the meeting on the layout of <br /> the cluster subdivision and the number of lots with minimum frontage. <br />
