Town of Mashpee <br /> j NIP %„' 16 Great Neck qtoad JVorth <br /> ,m <br /> Mashpee, Massachusetts 02649 <br /> UIE� <br /> BOARD OF APPEALS <br /> DECISION FOR A MODIFICATION OF SPECIAL PERMIT <br /> Re: Petition of Dick 'n Ellie's Flea Market 650 Falmouth Road <br /> Albert Wiseman, Manager- SP-97-24 Map 81, Block 4 <br /> A Petition was filed on February 18, 1997 by Albert Wiseman, Manager of Dick 'n <br /> Ellie's Flea Market for a renewal of Section 4 of the Modification of Special Permit 95-32. <br /> Section 4 states that: "No structures of a permanent nature are to be constructed, <br /> erected, or caused to be placed on the property used in connection with the flea market. <br /> Merchandise, equipment, banners and other gear for use in connection with the Flea <br /> Market are to be removed at the conclusion of each day's operation. Any poles which are <br /> to be used by the applicant to support tents are not to be considered structures for the <br /> purposes of this permit and canopies and tent sides used on these poles may remain <br /> overnight for the (1996) season. All tent canopies and sides are to be of uniform color. <br /> This condition is subject to renewal before the opening of the (1997) season.” The Flea <br /> Market is located in a C-1 zoning district at 650 Falmouth Road (Map 81, Block 4) <br /> Mashpee, MA. (Owner of record: Charles M. Talanian, TR.) <br /> Notice was duly given to abutters in accordance with Massachusetts General Laws <br /> Chapter 40A. Notice was given by publication in The Mashpee Enterprise, a newspaper <br /> of general circulation in the Town of Mashpee on March 7 and March 14, 1997, a copy of <br /> which is attached hereto and made a part hereof. <br /> A Public Hearing was held on the Petition at the Mashpee Town Hall on <br /> Wednesday, March 26, 1997 at 7:30 P.M. at which time the following members of the <br /> Board of Appeals were present and acting throughout: Edward M. Govoni, Cheryl A. <br /> Hawver and Robert G. Nelson. <br /> Mr. Wiseman represented the Petition. Comments were received from the <br /> Executive Secretary and the Police Chief regarding the traffic conditions at the site and the <br /> scheduling of police. Residents of the Deer Crossing Condominium Association requested <br /> a barrier to the Flea Market entrance opposite the Deer Crossing entrance and it was <br /> agreed that a gate would be installed and closed from 10 A.M. to 5 P.M. Mr. Wiseman <br /> also agreed to improve the trash pickup at the site. <br />
