Town of Mashpee
S s
16 Great Jlreck Poad Jlrorth
Z1. Mashpee,Massachusetts 02649
BOARD OF APPEALS
DECISION FOR A VARIANCE
I RE: Jane L. Lincoln- V-97-32 170 Pimlico Pond Road
` Map 2 Block 3
A Petition was filed on March 14, 1997 by Jane L. Lincoln of Marstons Mills,
04 Massachusetts for a Variance from Section 174-31 of the Zoning By-laws for permission
to vary the minimum frontage requirement in an R-5 zoning district on property located at
170 Pimlico Pond Road (Map 2, Block 3) Mashpee, MA.
` Notice was duly given to abutters in accordance with Massachusetts General Laws
Chapter 40A. Notice was given by publication in The Mashpee Enterprise, a newspaper
of general circulation in the Town of Mashpee, on April 4 and April 11, 1997, a copy of
` which is attached hereto and made a part hereof.
. A Public Hearing was held on the Petition at the Mashpee Town Hall on
Wednesday, April 23, 1997 at 7:30 P.M. at which time the following members of the
Board of Appeals were present and acting throughout: Edward M. Govoni, Cheryl A.
< Hawver and Michael A. Makunas.
t
This Decision is issued by the Mashpee Board of Appeals pursuant to the
provisions of Massachusetts General Law, Chapter 40A, Section 10 and Section 174-31
of the Mashpee Zoning By-laws.
Attorney Kevin M. Kirrane represented the applicant and informed the Board that
a Variance for frontage was granted by the Board in 1985 but the proposed house was
never built. He explained that there is an uninhabitable dwelling on the property which has
existed for many years and will be replaced with a new dwelling. He stated that the R-5
zoning requires 150 foot frontage and the lot has 139.38 feet and requires a variance of
10.62 feet.
