Board of Appeals Deer Crossing - Italian Market - L.L.R.C. Inc. SP-97-46 2. <br /> parking and landscaping. He explained that access to the patio will be from the Market <br /> only. The Board was informed that the Italian Market has a package store liquor license <br /> only and that no alcohol may be consumed on the premises. <br /> FINDINGS: <br /> 1. the subject property is located at 681 Falmouth Road and is part of the Deer <br /> Crossing shopping center. <br /> 2. the subject property received Special Permit 96-3 to allow for an addition to <br /> Building A. <br /> 3. Section 174-25.E.2 of the Zoning By-laws allows for eating places serving <br /> food and beverages to be consumed within a building upon grant of a Special <br /> Permit from the Board of Appeals. <br /> 4. Section 174-25.1.10 allows for outside dining as an accessory use to an <br /> allowed eating place. <br /> 5. the landscaping plans have been approved by the Design Review Committee. <br /> 6. the Board found that the proposed use would not be a detriment to the <br /> neighborhood and complies with the general provisions set forth within the By- <br /> laws. <br /> Upon motion duly made and seconded the Board of Appeals voted unanimously <br /> to grant the Special Permit subject to the following conditions: <br /> 1. outdoor dining be limited to eight tables of four seats <br /> 2., access to the patio will be from the Italian Market only <br /> 3. patio will be enclosed with a railing and privet hedge <br /> 4. the site be maintained to conform to the as-built plans of Annino Associates <br /> dated June 4, 1997 and signed by a member of the Board of Appeals. <br /> 5. the applicant must adhere to the liquor license restrictions as to the <br /> consumption of alcohol on the premises. <br />
