a � Town of Mashpee <br /> y 16 Great JVeck Poad JVonh <br /> BOARD OF APPEALS Mashpee, Massachusetts 02649 <br /> Decision for a Special Permit <br /> RE: Tuan Ha-Ngoc SP-97-54 164 Fells Pond Road <br /> Map 122, Block 202 <br /> A Petition was filed on August 5, 1997 by Tuan Ha-Ngoc of Lexington, <br /> Massachusetts for a Special Permit under Section 174-25.I.9 of the Zoning By-laws for <br /> the construction of a dock on Fells Pond on property located in an R-3 zoning district at <br /> 164 Fells Pond Road (Map 122, Block 202)Mashpee,MA. <br /> Notice was duly given to abutters in accordance with Massachusetts General Laws <br /> Chapter 40A. Notice was given by publication in The Mashpee Enterprise, a newspaper <br /> of general circulation in the Town of Mashpee, on August 8 and August 15, 1997, a copy <br /> of which is attached hereto and made a part hereof. <br /> A Public Hearing was held on the Petition at the Mashpee Town Hall on <br /> Wednesday, August 27, 1997 at 7:30 P.M. at which time the following members of the <br /> Board of Appeals were present and acting throughout: Edward M. Govoni, James E. <br /> Regan III and Cheryl A. Hawver. <br /> This Decision is issued by the Mashpee Board of Appeals pursuant to the <br /> provisions of Massachusetts General Law, Chapter 40A, Section 9 and Section 174-25 of <br /> the Mashpee Zoning By-laws. <br /> Engineer Michael Grotzke represented the applicant and presented revised plans <br /> for a dock 15 feet in length from the edge of the water. He informed the Board that the <br /> Conservation Commission had requested this reduction in the size of the dock. Comments <br /> were received from abutters opposed to the original plans but there were no objections to <br /> the revised design. <br />
