13. Specific findings of the Board, including findings <br /> that the project will cause negligible impact to environmental <br /> conditions and that turbidity caused by construction or propeller <br /> wash is minimized, are clearly based on information supplied <br /> solely by the applicant, which information is not current and <br /> out of date. Such findings were not the result of, an independent <br /> evaluation by the Board as required by law. <br /> 14 . Specific findings and determinations required <br /> by Section 174-24 (C) ( 2) of the Zoning Ordinance, including <br /> the fact that the project would not have a significant adverse <br /> impact on neighboring properties, were not made by the Board <br /> and were not incorporated in the decision. <br /> 15. General findings submitted by the Board indicate <br /> that the locus listed by the Board as the property that is the <br /> subject of their findings is not the locus listed in the <br /> petition. <br /> 16 . The decision of the Board was in excess of its <br /> authority and must be annulled. <br /> COUNT I <br /> WHEREFORE, the Plaintiffs respectfully request that <br /> the Court find that the decision of the Board exceeded its <br /> authority and annul the same. <br /> COUNT II <br /> WHEREFORE, the Plaintiffs respectfully request that <br /> the Court find the decision of the Board was based on incorrect <br /> and outdated information and remand the matter to the Board <br /> for further hearing. <br /> Respectfully Submitted <br /> Edward R.
