Blythe - SP-97-60 228 Wading Place Road <br /> Map 112 Block 59 <br /> A Petition was filed on August 27, 1997 by Frederic W. Blythe of Mashpee, <br /> Massachusetts for a Special Permit under Section 174-25.I.9 of the Zoning By-laws for <br /> permission to construct a pier, ramp and float on Popponesset Creek in an R-3 zoning <br /> district on property located at 228 Wading Place Road(Map 112, Block 59) Mashpee, <br /> MA. Special Permit 92-46 was granted by the Board of Appeals for this use and filed <br /> with the Town Clerk on September 24, 1992 and has expired. <br /> Notice was duly given to abutters in accordance with Massachusetts General Laws <br /> Chapter 40A. Notice was given by publication in The Mashpee Enterprise, a newspaper <br /> of general circulation in the Town of Mashpee, on September 5 and September 12, 1997, <br /> a copy of which is attached hereto and made a part hereof. <br /> A Public Hearing was held on the Petition at the Mashpee Town Hall on <br /> Wednesday, September 24, 1997 at 7:30 P.M. at which time the following members of the <br /> Board of Appeals were present and acting throughout: Edward M. Govoni, Cheryl A. <br /> Hawver and Michael A. Makunas. <br /> This Decision is issued by the Mashpee Board of Appeals pursuant to the <br /> provisions of Massachusetts General Law, Chapter 40A, Section 9 and Section 174-25.I.9 <br /> of the Mashpee Zoning By-laws. <br /> Mr. Blythe represented his petition. The Board noted that the applicant had <br /> received a Special Permit for the dock in 1992. This Decision was appealed and remanded <br /> to the Board and dismissed by the court on June 12, 1995 and the Special Permit expired <br /> on June 12, 1997. <br /> Comments were received from representatives of an abutter asking for a delay in <br /> the Decision and a review of the site conditions. <br />
