Board of Appeals Andrew Lipnosky- V-97-57 3. <br /> Specific Findings: <br /> 1. John Ewer Road has existed for more than ninety(90) years and has served as <br /> an access to the State boat ramp on Peter's Pond for many years. It has <br /> adequate sight distances from each of the prospective residential lot driveways <br /> and can be maintained at a sufficient width to provide adequate access for <br /> emergency vehicles. <br /> 2. the proposed lot sizes are consistent, if not greater than, other lots in the area <br /> and the proposed use is also consistent with the neighborhood. <br /> 3. substantial hardship would result without Variance relief since the land can be <br /> put to no useful purpose. <br /> 4. the topography and soil conditions affect this lot and not the district in which it <br /> is located and the planned road surfacing will improve public safety. <br /> Upon motion duly made and seconded the Board of Appeals voted unanimously on <br /> October 22, 1997 to grant a Variance from Section 174-12 of the Zoning By-laws with <br /> the condition that the applicant meet the requirements of Section 174-32 of the Zoning <br /> By-laws: <br /> 1. the applicant shall provide an all-weather surface roadway capable of <br /> supporting fire-fighting apparatus with an all-weather surface roadway, there <br /> shall be an unobstructed, paved access roadway of not less than 20 feet with a <br /> vertical clearance of not less than 13 feet six inches with all corners and curves <br /> having a minimum inside radius of not less than 28 feet and a minimum outside <br /> radius of not less than 46 feet. Said access roadway shall be constructed to a <br /> point not less than 150 feet from the furthest point of any building on the lot. <br /> 2. the all-weather surface roadway shall be required only along the lot frontage <br /> within the control of the applicant. <br /> 3. access to a paved road shall be from the Sandwich end of John Ewer Road and <br /> shall not be required from the Mashpee end of John Ewer Road. <br /> This Decision is referenced by plan 081297 of Cape&Islands Engineering. <br />
