Board of Appeals Frederic W. Blythe - SP-97-60 3.
The Board finds that the applicant has met his burden of proof, and the
structure and its proposed specifications will ensure that environmental damage
will be negligible. The Board further finds that the best available measures have
been proposed to minimize adverse affects on fisheries and wildlife habitat.
In view of the foregoing, the Mashpee Board of Appeals found that the
applicant met the criteria necessary for the granting of a Special Permit. Upon
motion duly made and seconded the Board of Appeals voted unanimously on
September 24, 1997 to grant the Special Permit. The Permit is conditioned upon
compliance with plans of Eagle Surveying and Engineering Inc. 91-009 revised
March 4, 1992 and provides for the maintenance and repair of the structure in
perpetuity.
