HAWVER, ) UNDER C 40A <br /> as they are members of the Mashpee ) <br /> Board. of Appeals, and 1 <br /> FREDERIC W. BLYTHE, ) <br /> DEFENDANTS ) <br /> 1 . Plaintiffs Edward R. Siegfried and Margo M. <br /> Siegfried, (hereinafter Siegfried) , are the owners of a certain <br /> parcel of land located at 220 Wading Place Road, Mashpee, <br /> Massachusetts consisting of smaller contiguous parcels of <br /> registered and unregistered land. Siegfried' s parcel is further <br /> delineated as Lots 5B and Lot C as shown on the plan attached <br /> hereto as Exhibit A. <br /> 2. Defendant Frederic W. Blythe, (hereinafter <br /> Blythe) ,is the owner of a certain parcel of land located at <br /> 228 Wading Place Road, Mashpee, Massachusetts consisting also <br /> of smaller contiguous parcels of registered and unregistered <br /> land. Blythe ' s parcel is further delineated as Lot 5E and Lot <br /> B as shown on Exhibit A. <br /> 3 . Siegfried is a direct abutter of Blythe. <br /> 4 . Edward M. Govoni, Michael A. Makunas , and Cheryl <br /> A. Hawver, (hereinafter the Board) , are the duly appointed <br /> members of the Zoning Board of Appeals of the Town of Mashpee, <br /> Massachusetts with offices at the Mashpee Town Hall located <br /> at 16 Great Neck Road North, Mashpee, Massachusetts . <br /> 5 . In 1992, Blythe filed with the Board a petition <br /> for a Special Permit to construct a pier, ramp, and float <br /> extending Seventy ( 70 ) feet from his property on Wading Place <br /> Road northwesterly into Poponesset Creek. Attached to that <br /> application was a plan,required by the Board, showing the <br /> proposed location of the structure and delineating wetland <br /> locations, certain vegetation locations, water depth and <br />
