Y , <br /> `IT,w <br /> s <br /> C4° Town of Nashpee <br /> 16 Great JVeck load North <br /> Mashpee, Massachusetts 02649 <br /> BOARD OF APPEALS <br /> Decision for a Variance <br /> RE: Maxwell Gates - V-97-71 18 Waterline Drive North <br /> Map 120, Block 177 <br /> A Petition was filed on October 10, 1997 by Maxwell Gates of Newton, <br /> Massachusetts for a Variance from Section 174-31 of the Zoning By-laws for permission <br /> to vary the setback requirements in an R-3 zoning district on property located at 18 <br /> Waterline Drive North (Map 120, Block 177)Mashpee, Massachusetts. The applicant <br /> requests a variance of.9 feet for an existing garage which is located 14.1 feet from the <br /> North side line and a variance of 13 feet in the rear to allow a setback of 7 feet from a <br /> proposed deck addition. <br /> Notice was duly given to abutters in accordance with Massachusetts General Laws <br /> Chapter 40A. Notice was given by publication in The Mashpee Enterprise, a newspaper <br /> of general circulation in the Town of Mashpee, on October 24 and October 31, 1997, a <br /> copy of which is attached hereto and made a part hereof. <br /> A Public Hearing was held on the Petition at the Mashpee Town Hall on <br /> Wednesday,November 12, 1997 at which time the following members of the Board of <br /> Appeals were present and acting throughout: Edward M. Govoni, James E. Regan III and <br /> Cheryl A. Hawver. <br /> This Decision is issued by the Mashpee Board of Appeals pursuant to the <br /> provisions of Massachusetts General Law, Chapter 40A, Section 10 and Section 174-31 <br /> of the Town of Mashpee Zoning By-laws. <br /> Engineer John Slavinsky represented the applicant and informed the Board that an <br /> addition to the house and deck is planned at the rear which will result in a 7 foot rear <br /> setback and that an existing garage was built 14.1 feet from the side line and requires a <br /> variance of.9 feet. He explained that the lot borders reserve land and that the owner has <br /> maintained the required 50 foot setback from the wetlands. <br />
