"ry Town of Mashpee <br /> 3 s <br /> 16 Great JVeck qtoad Arth <br /> q��1Ap1E�V "� <br /> BOARD OF APPEALS Mashpee, Massachusetts 02649 <br /> Decision for a Variance <br /> RE: William B. and Betsey Gagnebin 46 & 50 Hilltop Road <br /> Map 41 -Blocks 68 & 69 <br /> A Petition was filed by William B. and Betsey Gagnebin for a Variance from <br /> Section 174-31 of the Zoning By-laws for permission to vary the frontage and lot size <br /> requirements to allow the construction of a single family home on each of two lots located <br /> in an R-5 zoning district at 46 and 50 Hilltop Road (Map 41, Blocks 68 and 69)Mashpee, <br /> MA. <br /> Notice was duly given to abutters in accordance with Massachusetts General Laws <br /> Chapter 40A. Notice was given by publication in The Mashpee Enterprise, a newspaper <br /> of general circulation in the Town of Mashpee, on December 22, 1995 and December 29, <br /> 1995, a copy of which is attached hereto and made a part hereof. <br /> A Public Hearing was scheduled on the Petition at the Mashpee Town Hall on <br /> Wednesday, January 10, 1996 and canceled due to weather and rescheduled on <br /> Wednesday, January 17, 1996 at 7:30 P.M. at which time the following members of the <br /> Board of Appeals were present and acting throughout: Edward M. Govoni, James E. <br /> Regan III and Robert G. Nelson. <br /> This Decision is issued by the Mashpee Board of Appeals pursuant to the <br /> provisions of Massachusetts General Law, Chapter 40A, Section 10 and Section 174-31 <br /> of the Mashpee Zoning By-laws. <br /> Attorney Kevin M. Kirrane represented the applicants and informed the Board that <br /> the Gagnebins had owned the lots since 1967 and were not aware of the changes in zoning <br /> which were voted in 1990. He explained that they have been paying taxes and water <br /> betterments on two separate lots. <br />
