Board of Appeals Doe Family Trust/99 West Inc. V-96-17 3.
6. The proposed restaurant building will consist of fifty-seven hundred (5,700 sq.
ft.) square feet, and will have a seating capacity of one hundred fifty-eight
(15 8) patrons.
7. The proposed parking area will accommodate one hundred thirty-five (135)
spaces (including handicap).
8. The proposed signage plans were reviewed, revised and approved by the
Design Review Committee A mock-up of the free standing sign was placed on
the site several weeks in advance of the meeting and interested parties were
given an opportunity to comment and to attend the Design Review Committee
meeting at the site. No written objections were received by the Board.
9. The Board found that relief may be granted without derogating from the intent
of the By-law as the proposed internally lit free-standing sign only illuminates
the lettering and not the body of the sign. The proposed sign is a double-faced
sign and back-lighting would not be possible without creating hazardous glare
to oncoming traffic. The Board found that adequate signage is needed to
identify the site.
10. The Board found that the granting of a Variance would not be detrimental to
the neighborhood or to the Town as a whole.
Upon motion duly made and seconded the Board of Appeals voted unanimously on
April 10, 1996 to grant the Variance to allow internal illumination of a free-standing sign
with maximum square footage of 45 square feet , height of 10 feet 10 inches to the top of
the logo and the side base of 3 feet 6 inches from the grade and be placed 12 feet from
the lot line.
