Kent - SP-96-14 38 Kim Path <br /> Map 117 Block 92 <br /> A Petition was filed on January 22, 1996 by Marie D. Kent of Canton, <br /> Massachusetts for a Special Permit under Section 174-17 of the Zoning By-laws for <br /> permission to demolish an existing dwelling and rebuild a new dwelling in an R-3 zoning <br /> district on property located at 38 Kim Path(Map 117, Block 92)Mashpee, <br /> Massachusetts. <br /> Notice was duly given to abutters in accordance with Massachusetts General Laws <br /> Chapter 40A. Notice was given by publication in The Mashpee Enterprise, a newspaper <br /> of general circulation in the Town of Mashpee, on February 9 and February 16, 1996 , a <br /> copy of which is attached hereto and made a part hereof. <br /> A Public Hearing was held on the Petition at the Mashpee Town Hall on <br /> Wednesday, February 28, 1996 at 7:30 P.M. at which time the following members of the <br /> Board of Appeals were present and acting throughout: Edward M. Govoni, James E. <br /> Regan III and Kenneth E. Marsters. <br /> This Decision is issued by the Mashpee Board of Appeals pursuant to the <br /> provisions of Massachusetts General Law, Chapter 40A, Section 6 and Section 174-17 of <br /> the Town of Mashpee Zoning By-laws. <br /> Engineer David Sanicki represented the applicant and informed the Board that the <br /> existing house is set on blocks and would be replaced with a new permanent structure and <br /> a new septic system. He informed the Board that the new structure would be more in <br /> compliance with the Zoning By-laws than the previous cottage. No comments were <br /> received from abutters. <br />
