Board of Appeals Kostas and Ina K. Nenortas - V-96-21 2. <br /> Findings: <br /> A. General <br /> 1. the subject property consists of a lot 1.18 acres as shown as Lot 138 on <br /> Assessors' Map 2. It is shown on an"Approval Not Required" plan approved <br /> by the Planning Board on October 1, 1986 and recorded in the Barnstable <br /> Registry of Deeds in Plan Book 424, Page 46. <br /> 2. the applicant proposes to have the lot used for a single family home. <br /> 3. the immediate neighborhood consists of lots of similar size many of which have <br /> been improved with single family homes. <br /> 4. the lot borders on Wakeby Pond and is impacted by wetlands at the rear. <br /> B. Variance Criteria <br /> Section 10 of Chapter 40A requires that the permit granting authority determine <br /> that there are circumstances relating to the shape and topography which affect this lot and <br /> not the district in which it is located and that a literal enforcement of the by-laws would <br /> involve substantial hardship, financial or otherwise. <br /> C. Specific Findings <br /> 1. the petitioners have owned the real estate since 1968 and it has been separately <br /> assessed as a buildable lot since 1986. The lot complies with zoning, including <br /> frontage, except as to area. <br /> 1 the topography of the lot with a sharp drop from Pimlico Pond Road to <br /> Wakeby Pond and substantial wetland creates a hardship in the placement of a <br /> house on the lot. <br /> 3. the lot is larger than many of the developed lots in the immediate area. <br /> 4. the lot is now serviced by public water supply. <br />
