Board of Appeals Michael J. and Andrea L. Yanoff- V-96-22 3. <br /> 3. the 3.65 sideline setback on the northerly lot line abuts a reserved lot which has <br /> 21.35 feet frontage and will not adversely effect nearby property. The sideline <br /> setback on the southerly lot line is 17.89 feet and exceeds the zoning <br /> requirements. <br /> 4. the topography and shape affect this lot and not the zoning district in which it <br /> is located. <br /> 5. the Board determined that desirable relief may be granted without derogating <br /> from the intent and purpose of the Zoning By-laws and without detriment to <br /> the public good. <br /> In view of the foregoing, the Mashpee Board of Appeals found that the applicant <br /> met the criteria necessary for the granting of a Variance. Upon motion duly made and <br /> seconded, the Board of Appeals voted unanimously on March 27, 1996 to grant a variance <br /> in lot coverage of 2.63%to allow 22.63% lot coverage, a front setback variance of 11.70 <br /> feet to allow a front setback of 18.30 feet and a northerly side setback of 11.35 feet to <br /> allow a setback of 3.65 feet. The Variance is conditioned with compliance with plans of <br /> Michael H. Grotzke dated March 25, 1996 and signed by the Chairman of the Board of <br /> Appeals. <br />
