Board of Appeals Michael J. and Andrea L. Yanoff- V-96-22 3.
3. the 3.65 sideline setback on the northerly lot line abuts a reserved lot which has
21.35 feet frontage and will not adversely effect nearby property. The sideline
setback on the southerly lot line is 17.89 feet and exceeds the zoning
requirements.
4. the topography and shape affect this lot and not the zoning district in which it
is located.
5. the Board determined that desirable relief may be granted without derogating
from the intent and purpose of the Zoning By-laws and without detriment to
the public good.
In view of the foregoing, the Mashpee Board of Appeals found that the applicant
met the criteria necessary for the granting of a Variance. Upon motion duly made and
seconded, the Board of Appeals voted unanimously on March 27, 1996 to grant a variance
in lot coverage of 2.63%to allow 22.63% lot coverage, a front setback variance of 11.70
feet to allow a front setback of 18.30 feet and a northerly side setback of 11.35 feet to
allow a setback of 3.65 feet. The Variance is conditioned with compliance with plans of
Michael H. Grotzke dated March 25, 1996 and signed by the Chairman of the Board of
Appeals.
