Town of Nashpee 16 Great Neck T(oad Aorth Mashpee, Massachusetts 02649 BOARD OF APPEALS DECISION FOR A MODIFICATION OF SPECIAL PERMIT Re: Petition of Dick `n Ellie's Flea Market 650 Falmouth Road t Albert Wiseman, Manager - SP-96-31 Map 81, Block 4 A Petition was filed on March 18, 1996 by Albert Wiseman, Manager of Dick `n Ellie's Flea Market for a renewal of Section 4 of the Modification of Special Permit 95-32. Section 4 states that: "No structures of a permanent nature are to be constructed, erected, or caused to be placed on the property used in connection with the flea market. Merchandise, equipment, banners and other gear for use in connection with the Flea Market are to be removed at the conclusion of each day's operation. Any poles which are to be used by the applicant to support tents are not to be considered structures for the purposes of this permit and canopies and tent sides used on these poles may remain overnight for the(1996) season. All tent canopies and sides are to be of uniform color. This condition is subject to renewal before the opening of the (1997) season." The Flea Market is located in a C-I zoning district at 650 Falmouth Road (Map 81, Block 4) Mashpee,MA. (Owner of record: Charles M. Talanian, TR.) Notice was duly given to abutters in accordance with Massachusetts General Laws Chapter 40A. Notice was given by publication in The Mashpee Enterprise, a newspaper of general circulation in the Town of Mashpee on March 22 and March 29, 1996, a copy of which is attached hereto and made a part hereof. A Public Hearing was held on the Petition at the Mashpee Town Hall on Wednesday, April 10, 1996 at 7:30 P.M. at which time the following members of the Board of Appeals were present and acting throughout: Edward M. Govoni, Cheryl A. Hawver and Robert G. Nelson. P Mr. Wiseman represented the Petition and asked that the tent poles be allowed to _ remain in place overnight and folding tables stored. He agreed that all merchandise, equipment and other gear, banners and flags would be removed from the premises daily. The Board requested that the flood lights be pointed toward the sign and not on Route 28. The Board was informed that all fees to the Town had been paid.
