Town of Mashpee <br /> 16 Great.Neck Road Arth <br /> BOARD OF APPEALS Mashpee, Massachusetts 02649 <br /> Decision for a Variance <br /> RE: Stephen Berish V-96-36 99 Waterline Drive South -Map 125 Block 249 <br /> 37 Keel Way - Map 120 Block 133 <br /> A Petition was filed by Stephen Berish of Avon, Massachusetts for a Variance <br /> from Section 174-31 of the Zoning By-laws for permission to vary the side and rear <br /> setback requirements to allow the construction of a single family house on property <br /> located in an R-3 zoning district. The proposed site is a combination of two lots at 99 <br /> Waterline Drive South(Map 125, Block 249) and 37 Keel Way(Map 120, Block 133) <br /> Mashpee, MA. <br /> Notice was duly given to abutters in accordance with Massachusetts General Laws <br /> Chapter 40A. Notice was given by publication in The Mashpee Enterprise, a newspaper <br /> of general circulation in the Town of Mashpee, on April 19 and April 26, 1996, a copy of <br /> which is attached hereto and made a part hereof. <br /> A Public Hearing was held on the Petition at the Mashpee Middle School on <br /> Wednesday, May 8 at 7:30 P.M. at which time the following members of the Board of <br /> Appeals were present and acting throughout: Edward M. Govoni, James E. Regan III and <br /> Robert G. Nelson. <br /> This Decision is issued by the Mashpee Board of Appeals pursuant to the <br /> provisions of Massachusetts General Law, Chapter 40A, Section 10 and Section 174-31 <br /> of the Mashpee Zoning By-laws. <br /> Engineer Michael Grotzke represented the applicant and informed the Board that <br /> extensive wetlands surround the lots on almost three sides. He explained that the <br /> Conservation Commission required that the house be moved away from the wetlands. <br /> Letters were received from abutters and neighbors in favor of the application. <br />
