Board of Appeals Stephen Berish - V-96-36 3. <br /> 5. the Board determined that desirable relief may be granted without derogating <br /> from the intent and purpose of the Zoning By-laws and without detriment to <br /> the public good. <br /> In view of the foregoing, the Mashpee Board of Appeals found that the applicant <br /> met the criteria necessary for the granting of a Variance. Upon motion duly made and <br /> seconded, the Board of Appeals voted unanimously on May 8, 1996 to grant a variance of <br /> 12.5 feet on the North side to allow a sideline setback of 2.5 feet and a Variance of 8 feet <br /> on the West to allow a rear setback of 12 feet. The Variance is conditioned upon <br /> compliance with plans of Michael H. Grotzke#39281 revised April 16, 1996 and signed <br /> by the Chairman of the Board of Appeals. <br />
