Board of Appeals Stephen Berish - V-96-36 3.
5. the Board determined that desirable relief may be granted without derogating
from the intent and purpose of the Zoning By-laws and without detriment to
the public good.
In view of the foregoing, the Mashpee Board of Appeals found that the applicant
met the criteria necessary for the granting of a Variance. Upon motion duly made and
seconded, the Board of Appeals voted unanimously on May 8, 1996 to grant a variance of
12.5 feet on the North side to allow a sideline setback of 2.5 feet and a Variance of 8 feet
on the West to allow a rear setback of 12 feet. The Variance is conditioned upon
compliance with plans of Michael H. Grotzke#39281 revised April 16, 1996 and signed
by the Chairman of the Board of Appeals.
