Town of Mashpee
3
N 16 Great JVeck 4(oad Arth
BOARD OF APPEALS Mashpee, Massachusetts 02649
Decision for a Variance
RE: F. Keats and Ina C. Boyd 12 Bright Coves Way
Map 111, Block 43
A Petition was filed on March 27, 1996 by F. Keats and Ina C. Boyd of Mashpee,
r
Massachusetts for a Variance from Section 174-31 of the Zoning By-laws for permission
to vary the side line setback requirements to allow the addition of a breezeway and garage
on property located in an R-3 zoning district at 12 Bright Coves Way(Map 111,Block
43) Mashpee, MA.
Notice was duly given to abutters in accordance with Massachusetts General Laws
Chapter 40A. Notice was given by publication in The Mashpee Enterprise, a newspaper
of general circulation in the Town of Mashpee, on April 19, 1996 and April 26, 1996,
a copy of which is attached hereto and made a part hereof.
A Public Hearing was held on the Petition at the Mashpee Middle School on
Wednesday, May 8, 1996 at 7:30 P.M. at which time the following members of the Board
of Appeals were present and acting throughout: Edward M. Govoni, James E. Regan III
and Kenneth E. Marsters.
This Decision is issued by the Mashpee Board of Appeals pursuant to the
provisions of Massachusetts General Law, Chapter 40A, Section 10 and Section 174-31
of the Mashpee Zoning By-laws.
Engineer Michael Grotzke represented the Applicants and informed the Board that
they planned to add a breezeway and garage to a home which is located outside of the
New Seabury Special Permit area. He stated that the lot was created in 1961 in an R-75
zoning district which required 7 1/2 foot side setbacks. The lot is impacted by location
within the flood plain and the need to have a 20 foot setback from the septic system.
Comments were received from abutters in favor of the proposal.
