l! <br /> Town of Mashpee <br /> y. 16 Great Xeck Ttoad Jlrorth <br /> E Mashpee, Massachusetts 02649 <br /> BOARD OF APPEALS <br /> Decision on a Notice of Appeal <br /> RE: Merchant Financial Investment Corp. -NOA 96-38 51 Waterline Drive South <br /> Map 120 Block 145 <br /> A Petition was filed on April 29, 1996 by Merchant Financial Investment Corp. of <br /> Boston, Massachusetts appealing the decision of the Building Inspector denying the <br /> issuance of a building permit for a single family house on property located in an R-3 <br /> zoning district at 51 Waterline Drive South(Map 120, Block 145). The denial was based <br /> on the determination by the Building Inspector that the ownership records on the lot were <br /> incomplete. <br /> Notice was duly given to abutters in accordance with Massachusetts General Laws <br /> Chapter 40A. Notice was given by publication in The Mashpee Enterprise, a newspaper <br /> of general circulation in the Town of Mashpee, on May 3 and May 10, 1996, a copy of <br /> which is attached hereto and made a part hereof. <br /> A Public Hearing was held on the Petition at the Mashpee Middle School <br /> on Wednesday, May 22, 1996 at which time the following members of the Board of <br /> Appeals were present and acting throughout: Edward M. Govoni, James E. Regan III and <br /> Robert G. Nelson. <br /> This Decision is issued by the Mashpee Board of Appeals pursuant to the <br /> provisions of Massachusetts General Law, Chapter 40A, Section 8 . <br /> Engineer Michael Grotzke represented the applicant and presented plans for the <br /> construction of a single family house. He explained that the vacant lot was located in a <br /> subdivision which had been approved as a cluster in 1974 and the lot had been sold three <br /> times since the Planning Board approval. He informed the Board that the Building <br /> Inspector had requested the Board of Appeals review of the applicable zoning for the lot <br /> and had denied the applicant a building permit. <br />
