Cushner - SP-96-44 22 Samoset Road <br /> Map 125 Block 65 <br /> A Petition was filed by Richard M. Cushner of Tewksbury, Massachusetts for a <br /> Special Permit under Section 174-25.I.9 of the Zoning By-laws for the replacement of a <br /> seasonal dock with a permanent dock on property located in an R-3 zoning district at 22 <br /> Samoset Road (Map 125, Block 65)Mashpee, Massachusetts. <br /> Notice was duly given to abutters in accordance with Massachusetts General Laws <br /> Chapter 40A. Notice was given by publication in The Mashpee Enterprise, a newspaper <br /> of general circulation in the Town of Mashpee, on June 7, 1996 and June 14, 1996, a copy <br /> of which is attached hereto and made a part hereof. <br /> A Public Hearing was held on the Petition at the Carol H. Jacobson Senior Center <br /> on Wednesday, June 26, 1996, at which time the following members of the Board of <br /> Appeals were present and acting throughout: Edward M. Govoni, James E. Regan III and <br /> Robert G. Nelson. <br /> This Decision is issued by the Mashpee Board of Appeals pursuant to the <br /> provisions of Massachusetts General Law, Chapter 40A, Section 6 and Section 174-25.I.9 <br /> of the Town of Mashpee Zoning By-laws. <br /> Engineer Jeffrey L. Johnson represented the applicant and informed the Board that <br /> Dr. Cushner had received a Special Permit from the Board of Appeals for the dock in <br /> 1993 but that the permitting from other regulatory agencies had taken more than two <br /> years and that the permit had expired. Building Inspector William F. Hauck said that the <br /> application did not require a Variance for length since the original dock had been <br /> constructed prior to any length restrictions. <br />
