Nuey- V-96-45 45 Orchard Road <br /> Map 62 Block 4 <br /> A Petition was filed on June 17, 1996 by Elmyrna E. Nuey of East Providence, <br /> Rhode Island for a Variance from Section 174-32 of the Zoning By-laws to allow the <br /> construction of a single family home on an unpaved road on property located in an R-3 <br /> zoning district at 45 Orchard Road (Map 62, Block 4)Mashpee, MA. (Owner of record: <br /> Marion Dewillis). <br /> Notice was duly given to abutters in accordance with Massachusetts <br /> General Laws Chapter 40A. Notice was given by publication in The Mashpee Enterprise, <br /> a newspaper of general circulation in the Town of Mashpee, on July 5, 1996 and July 12, <br /> 1996, a copy of which is attached hereto and made a part hereof. <br /> A Public Hearing was held on the Petition at the Carol H. Jacobson Senior Center <br /> on Wednesday, July 24, 1996 at 7:30 P.M. at which time the following members of the <br /> Board of Appeals were present and acting throughout: Edward M. Govoni, James E. <br /> Regan III and Cheryl A. Hawver. <br /> This Decision is issued by the Mashpee Board of Appeals pursuant to the <br /> provisions of Massachusetts General Law, Chapter 40A, Section 10 and Section 174-32 <br /> of the Mashpee Zoning By-laws. <br /> Attorney Joseph V. Maruca represented the applicant. He informed the Board that <br /> the dirt road to the Nuey property is approximately 217 feet long and has been in use for <br /> 30 years. The total road is 300 feet long and has a 40 foot right of way. There is an <br /> existing house on the property across the street: He explained that the cost of paving the <br /> road would result in substantial hardship to the applicant. No comments were received <br /> from abutters. <br />
