Haidas (Cooke's Restaurant) V-96-51 7 Ryan's Way <br /> Map 67 Block 74 <br /> A Petition was filed on July 15, 1996 by James G. Haidas of Osterville, <br /> Massachusetts for a Variance from Section 174-40 of the Zoning By-laws for permission <br /> to vary the access way requirements in a C-1 zoning district to allow access way for <br /> parking on property located in a C-1 zoning district at 7 Ryan's Way(Map 67, Block 74) <br /> Mashpee; MA. (Owner of record: Garry T. Melia). <br /> Notice was duly given to abutters in accordance with Massachusetts General Laws <br /> Chapter 40A. Notice was given by publication in The Mashpee Enterprise, a newspaper <br /> of general circulation in the Town of Mashpee, on August 9, 1996 and August 16, 1996, <br /> a copy of which is attached hereto and made a part hereof. <br /> A Public Hearing was held on the Petition at the Carol H. Jacobson Senior Center <br /> on Wednesday, August 28, 1996, at which time the following members of the Board of <br /> Appeals were present and acting throughout: Edward M. Govoni, James E. Regan III and <br /> Cheryl A. Hawver. The hearing was closed and the Petition taken under advisement until <br /> the Board's hearing on September 11, 1996. 1 <br /> This Decision is issued by the Mashpee Board of Appeals pursuant to the <br /> provisions of Massachusetts General Law, Chapter 40A, Section 10 and Section 174-40 <br /> of the Town of Mashpee Zoning By-laws. <br /> Attorney Myer R. Singer represented the applicant and informed the Board that <br /> the Applicant proposes to construct a 5,464 square foot first floor and 3,342 square foot <br /> basement restaurant building with seating for one hundred and seventy(170) patrons. He <br /> explained that a Variance was necessary for the subject lot since it was not possible to <br /> construct on the land and comply with the requirements of the current by-law which <br /> requires 200 feet between accessways or the right-of-way line of a road intersection.
