\,lU1N 7„ <br /> Town of Mas pee <br /> 16 Great JVeck �koad Aorth <br /> Mashpee, Massachusetts 02649 <br /> BOARD OF APPEALS <br /> Record of Proceedings and Decision on an Appeal <br /> RE: Mashpee Water District -Notice of Appeal 96-48 <br /> RECORD OF PROCEEDINGS <br /> An Appeal was filed on June 26, 1996 by the Mashpee Water District appealing <br /> the May 28, 1996 Decision of the Building Inspector denying a request for zoning <br /> enforcement pursuant to M.G.L. Ch. 40A, Section 7. The Mashpee Water District had <br /> requested the Building inspector to rescind the Modification Agreement of May 22, 1995, <br /> between the Town of Mashpee and the New Seabury Operations Nominee Trust (the <br /> "Modification Agreement") and to rescind and revoke all permits issued to New Seabury <br /> under the Modification Agreement. The Mashpee Water District appealed the Building <br /> Inspector's decision pursuant to M.G.L. c.40A, Section 8, requesting that all permits <br /> issued to New Seabury under the Modification Agreement be revoked and rescinded and <br /> that the Modification Agreement itself be rescinded or, in the alternative, that the Board <br /> determine that Zoning Board of Appeals action is necessary. <br /> The subject property is known as Section 5 of the New Seabury Cluster <br /> Development and is located at 155 and 163 Rock Landing Road, (Map 116, Blocks 70 <br /> and 70A), 70 Cross Road (Map 116-74). (Owner of record: Christopher Burden TR. <br /> N.S. Operations Nominee Trust) and 24 Mall Way(Map 116, Block 69) (Owner of <br /> record: Christopher Burden). <br /> Notice was duly given to abutters in accordance with Massachusetts General Laws <br /> Chapter 40A. Notice was given by publication in The Mashpee Enterprise, a newspaper <br /> of general circulation in the Town of Mashpee, on August 9 and August 16, 1996, a copy <br /> of which is attached hereto and made a part hereof. <br />
