Brum 96 Old Colony Drive <br /> Map 35, Block 50 <br /> A Petition was filed on September 18, 1996 by Antonio F. and Michelle E. Brum <br /> for a Variance from Section 174-47 of the Zoning By-laws to vary the side setback <br /> requirements in a cluster subdivision to allow the construction of a garage on property <br /> located in an R-5 zoning district at 96 Old Colony Drive (Map 35,Block 50)Mashpee, <br /> MA. <br /> Notice was duly given to abutters in accordance with Massachusetts General Laws <br /> Chapter 40A. Notice was given by publication in The Mashpee Enterprise, a newspaper <br /> of general circulation in the Town of Mashpee, on September 20, 1996 and September 27, <br /> 1996, a copy of which is attached hereto and made a part hereof. <br /> A Public Hearing was held on the Petition at the Carol H. Jacobson Senior Center <br /> on Wednesday, October 9, 1996 at 7:30 P.M. at which time the following members of the <br /> Board of Appeals were present and acting throughout: Edward M. Govoni, James E. <br /> Regan III and Cheryl A. Hawver. <br /> This Decision is issued by the Mashpee Board of Appeals pursuant to the <br /> provisions of Massachusetts General Law, Chapter 40A, Section 10 and Section 174-31 <br /> of the Mashpee Zoning By-laws. <br /> John Finn, Contractor, represented the Petition and informed the Board that an <br /> error had been made in the construction of a garage and the foundation had been placed <br /> 12.7 feet from the side line setback instead of the required 15 feet. He explained that <br /> there was a question of the applicable zoning requirements on the lot. No comments were <br /> received from abutters. <br />
