Board of Appeals Minutes - January 11, 1995 4. <br />Elizabeth Petti - Appeals of the Building Inspector's Decision (Continued from August <br />24, 1994) <br />Members sitting: E. Govoni, C. Hawver, R. Nelson <br />Mr. Govoni stated that the Board had required deed searches to determine ownership <br />when the lots became non -conforming in November, 1959 and had been advised by Town <br />Counsel that the lots were protected if they were in separate ownership at that time. <br />Lot 6: He read Findings of Fact and determined that Lot 6 at 88 Uncle Percy's Road was <br />in separate ownership in November, 1959 by Paul J. Moriarty. <br />Mr. Govoni moved to vote in favor of the applicant and determined that the decision of <br />the Building Inspector should be reversed. Ms. Hawver seconded. All agreed. <br />Lot 8: Mr. Govoni read the Findings of Fact and determined that Lot 8 was not in <br />separate ownership in November, 1959 but was owned by Alfred V. Boursy and Marie E. <br />Boursy who also owned Lot 7. <br />Mr. Govoni moved to deny the Appeal of the Building Inspector's Decision without <br />prejudice. Mr. Nelson seconded. All agreed. <br />• Minutes - Mr. Govoni moved to accept the Minutes with a correction in page 1. Mr. <br />Nelson seconded. All agreed. <br />Mashpee High School Building Committee - The Board was informed that the Building <br />Committe was requesting a waiver of fees for a Special Permit and Variance application. <br />Mr. Govoni moved to grant the waiver. Mr. Regan seconded. All agreed. <br />Mr. Govoni moved to adjourn at 8:45 P.M. Mr. Regan seconded. All agreed. <br />Elinor Walsh <br />• <br />
