R <br />it <br />• TOWN OF MASHPEE <br />Board of Appeals <br />Minutes <br />Wednesday, January 25, 1995 <br />The Mashpee Board of Appeals held a meeting on Wednesday, January 25, 1995 at 7:30 <br />P.M. at the Mashpee Town Hall. Board members present: Edward M. Govoni, James E: <br />Regan III, Kenneth E. Marsters and Robert G. Nelson. Members absent: John J. Friel, <br />Cheryl A. Hawver and Arnold D. Mindick. Building Inspector William F. Hauck was in <br />attendance. <br />George Benway Jr. - Requests a Variance from Sections 174-31 and 174-32 of the Zoning <br />By-laws to vary the front yard setback requirements and allow the constructions of a <br />single family dwelling on an unpaved road on property located in an R-5 zoning district at <br />11 Bay Road (Map 114, Block 36A). (Owner of record: John and Ann Kelleher). <br />Members sitting: E. Govoni, J. Regan, R. Nelson <br />Mr. Govoni announced that this was a Chapter 112 hearing since real estate taxes were <br />owed on the property. Engineer Robert Raymond represented the applicant and explained <br />that the land was in the process -of being sold and taxes would be paid at the time of sale. <br />He explained that the house location on the lot had been approved by the Conservation <br />• Commission which requested maximum setback from the top of the bank. He stated that <br />the new deed for the property will show ownership to the middle of the road. He also <br />explained that other homes were located on similar unpaved roads in the area. <br />Mr. Nelson moved to grant the Variance of 6 1/2' to allow a front setback of 18 1/2 ` and <br />to permit construction on an unpaved road. <br />Patricia F. McNutt - Requests a Variance from Sections 174-11 and 174-32 of the Zoning <br />By-laws to allow the construction of a single family dwelling on an unpaved road on a lot <br />transected by a zoning district boundary between C-2 and R-3 on property located at 21 <br />Quippish Road (Map 55, Block 6) Mashpee, MA. <br />Members sitting: E. Govoni, J. Regan, K. Marsters <br />Tony Bexter represented the applicant and explained that there are three existing houses <br />on Quippish Road and Town water has been installed. He said this is the last lot on the <br />road and that the road is accessible to all the houses. <br />Mr. Marsters moved to grant the Variance. Mr. Regan seconded. All agreed. <br />Kathryn R. Laoio - Requests a Variance from Section 174-25.C.2 to vary the setback <br />requirement of 150' for buildings housing livestock on property located in an R-5 zoning <br />district at 237 South Sandwich Road (Map 15, Block 11) Mashpee, MA. (Owner of <br />• record: Louis A. Lapio, TR.). <br />
