i Board of Appeals Minutes - February 22, 1995 2. <br />• Mr. Solien stated that the Building Inspector had requested information on parking spaces. <br />He said he had been studying parking at Falmouth High School . He said the current plan <br />is to provide 202 parking spaces in the base contract for students and 58 and 48 additional <br />spaces for faculty. He said there are additional parking lots planned which do not need to <br />be constructed when the school is first opened and distributed information on additional <br />parking requirements as grades are added. <br />Arthur R. and Darlene E. Joia - Request a Special Permit under Section 174-17 of the <br />Zoning By-laws to allow for the relocation of a garage on property located in an R-5 <br />zoning district at 49 Somerset Road (Map 16, Block 11) Mashpee, MA. <br />Members sitting: E. Govoni, J. Regan, C. Hawver, fK /rl <br />Attorney Robert Zeida represented the applicant and explained that the applicant had built <br />a garage on land which is now determined to belong to an abutter. He wants to relocate <br />the garage to his own property. There was discussion on the setback. <br />Harriet Baker, an abutter, stated that the building had been built on 2/8/94 although the <br />building permit was dated 5/9/94. She said her family owned the land on which the garage <br />was built. She said she spoke with the Building Inspector in May and he put a stop work <br />order on the garage. Mr. Joia poured a foundation on his property to move the garage. <br />Mr. Hauck explained that Mr. Joia and the abutting Baker -Haywood familly were <br />• negotiating to allow the removal of the garage. Ms. Haywood said they would like the <br />building off her property if she gets restitution. She said they have no objections to the <br />proposed location of the garage on his property but she would not allow anyone on her <br />property. Mr. Govoni explained that Mrs. Baker's problem was a civil action. <br />Mr. Joia said he had been told to apply for the Special Permit rather than Variance. Mr. <br />Hauck said he would review the zoning. <br />Clay Baker, an abutter, said they would not allow Arthur Joia on the property. Dave <br />M%ttiker, an abutter, said Mr. Joia was improving the property. Mr. Govoni asked if <br />anyone would object to the Special Permit and no one objected. <br />Mr. Govoni moved to take the petition under advisement. Ms. Hawver seconded.
