• TOWN OF MASHPEE <br />Board of Appeals <br />Minutes -April 12, 1995 <br />The Mashpee Board of Appeals held a meeting on Wednesday, April <br />12, 1995 at 7:30 p.m. at the Mashpee Town Hall. Board members <br />present and acting throughout were: Edward M. Govoni, James <br />E. Regan III, Kenneth E. Marsters, and Robert G. Nelson. Board <br />members absent were: John J. Friel, Cheryl Hawver, and Arnold <br />D. Mindick. <br />Dick'n Ellie's Flea Market - Albert Wiseman, Manager - Requests <br />a renewal of Section 4 of the Modification of Special Permit <br />94-29. Section 4 states that: "No structures of a permanent <br />nature are to be constructed, erected, or caused to be placed <br />on the property used in connection with the flea market. <br />Tables, equipment and other gear placed on the property for <br />use in connection with the flea market are to be removed at <br />the conclusion of each day's operation. Any poles which are <br />used by the applicant to support tents are not to be considered <br />structures for the purposes of this permit and canopies and <br />tent sides used on these poles may remain overnight for the <br />1995 season. All tent canopy sides are to be of uniform color. <br />This condition is subject to renewal before opening of the 1995 <br />season. <br />• Members sitting: E. Govoni, K. Marsters, R. Nelson <br />Albert Wiseman stated that everything went well last year. <br />Mr. Govoni asked if the trailor could be put out of sight, and <br />Mr. Wiseman stated he would move it to comply. Mr. Govoni asked <br />if the sign light could be better positioned, and Mr. Wiseman <br />stated that he is going to move it back'so that the light hits <br />only the sign. Mr. Hauck suggested plantings to block the light <br />from hitting the road. Mr. Govoni asked about banners and flags, <br />and Mr. Wiseman stated they were brought down. Mr. Govoni asked <br />if there were any questions, and Dominique Dimaggio asked if <br />tables had to be removed each night (since he has a heart <br />condition). Mr. Govoni stated no but that merchandise has to <br />be removed each night. Mr. Regan suggested painting or putting <br />up white plywood for a neater appearance out front; Mr. Wiseman <br />will do that. <br />Mr. Govoni moved to allow tents and canopies to remain overnight <br />for the 1995 season. Mr. Nelson seconded. All agreed. <br />Stephen C. Kathy Kyros - Requests a Variance from Section 174- <br />25.F.7 of the Zoning By-laws to allow for a drive-through window <br />in a pastry, doughnut and coffee shop in a C-2 zoning district <br />on property located at 44 Falmouth Road (Map 55, Block 18) <br />Mashpee, MA. (Owner of record: Merry Meadow Enterprises Inc.). <br />0 <br />
