• Upon motion duly made and seconded the Board of Appeals voted unanimously on
April 12, 1995 to grant the following Variances:
1. A Variance of 12' from the 28.3' x48.2' existing bam to Devonshire Drive
allowing for a 38' setback
2. A Variance of 19'6" from the arena to Devonshire Drive allowing for a 30'4"
setback from Devonshire Drive and a Variance of 7' from Warwick Way allowing for a
43' setback.
3. A Variance of 1' from the 36'3" x 687" bam to South Sandwich Road
allowing for a setback of 49'.
The Variances are subject to the following conditions:
1. no more than ten horses may be housed on the property at any one time
2. the two existing barns or arena cannot be used for living quarters.
SPECIFIC FINDINGS
• 1. The Board found that the Applicant requires a Variance from the setback requirements
to ligitimate the location of the farm buildings.
2. The lot is unique from other lots in the said district due to the fact that it is surrounded
on three (3) sides by streets or ways.
3. A literal enforcement of the By-laws would cause substantial hardship if existing
buildings were required to be removed
4. The setback requirements relate to this particular property and the shape of the lot
prevents conformance.
5. The Board found that the residents of the neighborhood and direct abutters were in
support of the Variances and that relief could be granted without detriment to the
public good.
LI
