• <br />Town of Mashpee <br />Board of Appeals <br />Minutes <br />Wednesday, April 26, 1995 <br />The Mashpee Board of Appeals held a meeting on Wednesday, April 26, 1995 at 7:30 <br />P.M. at the Mashpee Town Hall. Board members present and acting throughout were: <br />James E. Regan III, Cheryl A. Hawver, Kenneth E. Marsters and Robert G. Nelson. <br />Board members absent were: Edward M. Govoni, John J. Friel and Arnold D. Mindick. <br />Building Inspector William F. Hauck was in attendance. <br />Acting Chairman Regan called the meeting to order at 7:33 P.M. <br />Stephen and Kathy Kyros - (Advisement from April 12, 1995). <br />Mr. Kyros said he had met with Design Review and made some changes to the original <br />plans. He said they have removed 5 parking spaces and put in a 6' buffer zone and added <br />a guardrail. The Design Review wanted the dumpster to remain in the same location but <br />be enclosed in an 8' fence with aborvitae planted around it. He noted that the lighting will <br />be improved by using the state poles. Mass. Highway has not yet ruled on the access from <br />28 and Greg Taylor said he had no problem with the access from Cape Drive. <br />(� Milton H. Hendricks - Requests a Variance from Sections 174-12, 174-21 and 174-32 of <br />the Zoning By-laws to allow the construction of a single-family home on an unpaved road <br />on property located in an R-5 zoning district at 25 Bookers Road (aka Simon Lowe Road) <br />(Map 35, Block 19A) Mashpee, MA. <br />Members sitting: J. Regan, C. Hawver, R. Nelson <br />Attorney Robert Mills represented the applicant. He explained that Simon Lowe Road, <br />also known as Booker Road, is an unpaved road off of Lovell's Lane. The planning <br />department determined that it was a public way with owners unknown. Mr. Mills said he <br />had notified the Fire Department but had received no comments. He said it was the last <br />buildable lot on the road and has no other viable use without a variance. Mr. Nelson <br />asked if the house would be 600' from a paved road. Mr. Marsters noted that the road <br />was wider than many dirt roads. <br />Helen Edwards, an abutter, said the road has not been used for 47 years and could be <br />accessed from the other end and she did not want people passing her home.. Mr. Mills <br />said the owner has rights to use the road. He explained to Ms. Edwards that the road was <br />not going to be paved but needed to maintained as a dirt road. Mary Lopez, a friend of <br />Ms. Edwards, asked why they could not use other access. <br />• Ms. Hawver moved to take the petition under advisement. Mr. Nelson seconded. All <br />agreed. <br />
