• TOWN OF MASHPEE <br />BOARD OF APPEALS <br />Minutes <br />Wednesday, July 26, 1995 <br />The Mashpee Board of Appeals held a meeting on Wednesday, July 26, 1995 at 7:30 P.M. <br />at the Mashpee Town Hall. Board members present were: Edward M. Govoni, <br />Chairman; James E. Regan III, Clerk and Associate Members Kenneth E. Marsters and <br />Robert G. Nelson. Members absent were John J. Friel and Cheryl A. Hawver. Building <br />Inspector William F. Hauck was in attendance. <br />.Joseph P. and Jennifer H. Martin - Request a Variance from Section 174-25.C.2 of the <br />Zoning By-laws to allow the construction of a barn 87 feet from the rear property line in <br />an R-3 zoning district on property located at 122 Red Brook Road (Map 112, Block 66) <br />Mashpee, MA. <br />Members sitting: E. Govoni, J. Regan, K. Marsters <br />Engineer John Slavinsky represented the applicant and explained that the lot is irregularly <br />shaped and has a low area with poor drainage. The applicant planned to locate the <br />proposed barn away from the wet area. He said he thought the intent of the by-law was to <br />protect abutters and the proposed location will be 246' from one abutter and 244' from <br />• another. The 87' setback will be to the proposed wildlife refuge. Robert Slavinsky, a <br />direct abutter, -spoke in favor of the proposed location. <br />Mr. Marsters moved to grant the Variance. Mr. Regan seconded. All agreed. Mr. <br />Govoni found that the topography of the land created a hardship and the location of the <br />bam was an improvement for both residential abutters. He granted a 63' Variance on the <br />south side of the property. <br />Northworks Properties Inc. - Request a Special Permit under Section 174-25.I.9 of the <br />Zoning By-laws for a proposed pier, ramp and float on Popponesset Creek in an R-3 <br />zoning district on property located at 95 Popponesset Island Road (Map 112, Block 31) <br />Mashpee, MA. <br />Members sitting: E. Govoni, J. Regan, R. Nelson <br />Engineer David Sanicki represented the applicant and explained that the owner is planning <br />a 50 foot dock with a 6' x 20' float. He said that Conservation has approved the project <br />subject to the issuance of the Special Permit. Mr. Regan moved to grant the Special <br />Permit. Mr. Nelson seconded.
