Board of Appeals Minutes - July 26, 1995 <br />Jim McGonigle, an abutter, said that he was concerned about other land on John Ewer <br />Road and discussed one parcel of 17 acres which might be developed. He informed the <br />Board that John Ewer Road was used to haul ice from Peter's Pond. He said that the <br />entrance to the Road washes out regularly. Mr. Govoni said the owner of the 17 acres <br />would have to have subdivision approval. Mr. Kirrane said they might get 7 or 8 lots from <br />the Planning Board. He said the two Bochanowski lots are valid lots due to the <br />Agreement for Judgment and he reviewed the ownership as separate. He stated that the <br />litigation ended in 1991 and that the owner had five years of protection since then. <br />Mr. Nelson noted that the only issue before the Board was related to fire protection under <br />the by-law. Bob Ebberling, an abutter, asked who would be concerned about the location <br />of the telephone pole and condition of road and Mr. Govoni responded that this would be <br />a safety issue. Mr. Watt said the corner lot had been one lot which was subdivided. Mr. <br />Kirrane presented a copy of a letter from former Town Counsel Leslie Morse stated that <br />the Agreement of Judgment was Sled October 10, 1991. <br />Mr. Regan stated that he would be stepping down on this case. <br />Mr. Marsters moved to take the application under advisement. Mr. Nelson seconded. All <br />agreed. <br />• Mr. Govoni called a recess at 8:45 P.M. The Board reconvened at 8:55 P.M. <br />James H. Kanter - Requests a Variance from Section 174-31 of the Zoning By-laws for <br />permission to vary the front setbackrequirements to allow for the construction of a 12.5' <br />x 16' house addition with a front setback of 12.2' from Kanter Way. The property is <br />located in an R-3 zoning district at 6 Kanter Lane (Map 119, Block 1B). <br />Members present: E. Govoni, J. Regan, K. Marsters, R. Nelson <br />Engineer Jack Landers-Cauley represented the applicant and explained that he was <br />planning a house addition. He explained that a hardship existed in the shape of the lot <br />preventing expansion in other directions. Mr. Govoni stated that the Board would need <br />some elevations of the proposed addition. Mr. Marsters agreed that the Board should <br />have some idea of what was proposed. Mr. Kanter said he had a contractor's plan and <br />would present it to the Board.. Mr. Regan moved to continue the hearing to August 23. <br />Mr. Govoni seconded. All agreed. <br />0 <br />
