TOWN OF MASHPEE <br />BOARD OF APPEALS <br />Minutes <br />Wednesday, August 23, 1995 <br />The Mashpee Board of Appeals held a meeting on Wednesday, August 23, 1995 at <br />7:30 P.M. at the Mashpee Town Hall. Board Members present were: Edward M. <br />Govoni, Chairman and Associate Members Kenneth E. Marsters and Robert G. Nelson. <br />Board Members absent were James E. Regan III, John J. Friel and Cheryl A. Hawver. <br />Building Inspector William F. Hauck was in attendance. <br />Daniel P. and Susan M. Spurlins - Request a Variance from Section 174-31 of the Zoning <br />By-laws for permission to vary the sideline setback requirements to allow for a 2.2' <br />setback. The applicant proposes to add a 14' x 37' deck to an existing dwelling on <br />property located in an R-5 zoning district at 55 Redwood Circle (Map 27, Block 97) <br />Mashpee, MA <br />Members sitting: E. Govoni, K. Marsters, R Nelson <br />Mr. Spurting represented his application and explained that he planned to build a deck on <br />• the side of the lot abutting the reserve area of Mashpee Shores. A letter was received <br />from the Association of Mashpee Shores owners in favor of the project and that <br />Conservation had approved the plans. Mr. Spurling explained that the land drops off on <br />one side and that this was the only location for the deck. <br />Mr. Marsters moved to grant the Variance to allow for the 2.2' setback. Mr. Nelson <br />seconded. All agreed. Mr. Govoni stated that the shape and topography created a <br />hardship and that the location of the house and septic system prevented expansion in other <br />areas. <br />Joseph & Nma Gardner - Request a Variance from Section 174-31 and 174-33 of the <br />Zoning By-laws for permission to vary the front setback requirements to allow for a 25' <br />front setback and to vary the setback from the wetlands to allow for a 34.3' rear setback <br />from the vegetated wetlands on property located in an R-3 zoning district at 175 Surf <br />Drive (Map 102, Block 14) Mashpee, MA. <br />Members sitting: E. Govoni, K. Marsters, R. Nelson <br />Engineer Edward Pesce represented the applicant and explained that the Board of Health <br />and Conservation have agreed to the setbacks from the wetlands. He said that <br />Conservation would prefer a 24' front setback to increase the buffer zone. Mr. Govoni <br />asked if the lot had an earlier Order of Conditions and Mr. Pesce said they had an earlier <br />• Order but had not constructed the septic system <br />
