'i Board of Appeals Minutes - August 23, 1995 3. <br />James H. Kanter - Requests a Variance from Section 174-31 of the Zoning By-laws for <br />permission to vary the front setback requirements to allow for the construction of a 12.5' <br />x 16' house addition with a front setback of 12.2' from Kanter Way. The property is <br />located in an R-3 zoning district at 6 Kanter Lane (Map 119, Block 1B). (Continued from <br />July 26, 1995). <br />Members sitting: E. Govoni, K. Musters, R. Nelson <br />The Board reviewed the elevations of the second floor addition and photographs of the <br />home. <br />The proposed lot coverage will be 9%. <br />Mr. Marsters moved to grant a Variance of 17.8' in the front setback to allow for a 12.2 <br />front setback. Mr. Govoni seconded. All agreed. The Board found that the shape and <br />topography of the lot created a hardship in the placement of the addition and that it was <br />not a detriment to the neighborhood. <br />Donna Bochanowski - (Continued from July 26, 1995) <br />Members sitting: E. Marsters, R Nelson <br />• Mr. Govoni reviewed correspondence from the applicant's attorney and discussed possible <br />conditions for the Decision: <br />1. utility pole to be moved from front entry of John Ewer Road <br />2. owner agree to perpetual maintenance to assure safe access of emergency <br />vehicles on John Ewer Road <br />impose covenant on deed to insure that maintenance be continued if property <br />sold <br />Mr. Nelson noted the pole is maintained by telephone co. and not Com Ed. N.E. Tel. has <br />to move the pole. He stated that some of the cables can be touched from the ground and <br />the Board should notify the selectmen of the safety hazard. Mr. Govoni said the Board <br />decision should condition that the pole be moved. He also said he had met with the Fire <br />Chief and presented him with recent cases prohibiting the Board from any conditions <br />concerning the inside of the house. <br />Mr. Govoni said that the Department of Public Works will plow the road but will not <br />grade it. He said maintenance should include cutting brush at the side of the road and <br />filling major potholes to have a passable road 20' in width. Mr. Marsters noted that the <br />Board should have the correct legal language to achieve a permanent requirement for <br />maintenance. <br />0 <br />
