Board of Appeals/Minutes November 8, 1995/Paye 2
there; (5) House was set back 60 feet from the front and there
would not be a problem if the builder had adhered to the usual
30 foot setback; (6) Literal enforcement of the By law would
involve hardship to the petitioner.
Review of Zoning By-laws
Discussion occurred regarding adoption of a zoning By-law
amendment permitting development of undersized lots. The By-
law requires the selection of a cut-off date by which the land
or lots in question must have existed as a separately owned
parcel, and the selection of minimum dimensional requirements.
Mr: Govoni stated that the Board will have to determine the
parameters (regarding the size and time limits). Mr. Govoni
suggested going back to the way the By-law was previously written
allowing up to three lots that are contiguous and containing
at least 7,500.square feet. Mr. Govoni suggested making a
two-year moratorium with ownership prior to 1985 and changing
the limit to 6,500 square feet since there are lots of this
size in existence. Board of Appeals can set the parameters,
but it would still have to meet the Board of Health code. Since
this would be an Article for the May Town .Meeting, it would
be appropriately advertised to inform property owners. Mr.
Govoni asked Board members to write down some ideas and bring
them to the December 13, 1995 meeting for comparison and final
consensus.
Minutes: Mr. Govoni made the motion to accept the Minutes of
October 25, 1995. Mr. Marsters seconded. All agreed.
Mr. Govoni moved to adjourn at 8:15 p.m. Ms. Hawver seconded.
All agreed.
Mary Gelsthorpe
Alternate Board Secretary
