Board of Appeals/Minutes November 8, 1995/Paye 2 <br />there; (5) House was set back 60 feet from the front and there <br />would not be a problem if the builder had adhered to the usual <br />30 foot setback; (6) Literal enforcement of the By law would <br />involve hardship to the petitioner. <br />Review of Zoning By-laws <br />Discussion occurred regarding adoption of a zoning By-law <br />amendment permitting development of undersized lots. The By- <br />law requires the selection of a cut-off date by which the land <br />or lots in question must have existed as a separately owned <br />parcel, and the selection of minimum dimensional requirements. <br />Mr: Govoni stated that the Board will have to determine the <br />parameters (regarding the size and time limits). Mr. Govoni <br />suggested going back to the way the By-law was previously written <br />allowing up to three lots that are contiguous and containing <br />at least 7,500.square feet. Mr. Govoni suggested making a <br />two-year moratorium with ownership prior to 1985 and changing <br />the limit to 6,500 square feet since there are lots of this <br />size in existence. Board of Appeals can set the parameters, <br />but it would still have to meet the Board of Health code. Since <br />this would be an Article for the May Town .Meeting, it would <br />be appropriately advertised to inform property owners. Mr. <br />Govoni asked Board members to write down some ideas and bring <br />them to the December 13, 1995 meeting for comparison and final <br />consensus. <br />Minutes: Mr. Govoni made the motion to accept the Minutes of <br />October 25, 1995.
