F <br />TOWN OF MASHPEE <br />BOARD OF APPEALS <br />Minutes <br />December 13, 1995 <br />The Mashpee Board of Appeals held a meeting on Wednesday, December 13, 1995 at <br />7:30 P.M. at the Mashpee Town Hall. Board members present and acting throughout <br />were: Edward M. Govoni, Chairman; James E. Regan III, Clerk and Associate Members <br />Cheryl A. Hawver, Kenneth E. Marsters and Robert G. Nelson. Member absent: John J. <br />Friel. Building Inspector William F. Hauck was in attendance. <br />Maurice and Clara Temple - Request a Special Permit under Sections 174-25.A.8 and <br />174-17 of the Zoning By-laws for a pre-existing non -conforming two family dwelling in an <br />R-5 zoning district on property located at 47 Beechwood Drive (Map 29, Block 47) <br />Mashpee, MA. <br />Members sitting: E. Govoni, J. Regan, C. Hawver <br />Attorney Rebecca Richardson represented the applicant. She explained that the owners <br />• had purchased the property in 1985 when it was being used as a two-family home and was <br />assessed as a two-family home. She stated that Building Permits were issued in 1980 and <br />1984 for the conversion of the basement to a separate apartment. Mr.Govoni noted that <br />the apartment was less than the 750 square feet specified in the by-law. Mr. Govoni said <br />that since they had a building permit for a two-family which was over 6 years old the <br />property is automatically protected. Mr. Hauck explained that after 10 years the <br />improvements are legal even if there is not a permit. <br />Mr. Govoni moved to grant the Special Permit under Section 174-17 since the house has <br />been used as a two-family dwelling for more than 10 years which would make it legal <br />under Chapter 40A Section 7 and that there is adequate land area and sufficient parking. <br />He found that it was no more detrimental to the neighborhood. Mr. Hauck stated that the <br />owner should be required to obtain a Building Permit to conform to code on egress and <br />smoke alarms. Mr. Govoni stated that the Decision should be so conditioned. Ms. <br />Hawver seconded. All agreed. <br />John A. and Kathleen Bibo - Request a Special Permit under Section 174-25.I.9 of the <br />Zoning By-laws for a pier, ramp and float in Popponesset Bay in an R-3 zoning district on <br />property located at 58 Captain's Row (Map 96, Block 5) Mashpee, MA. <br />Members sitting: E.
