Kurker- V-95-6 <br /> A Petition was filed by Ronald J. Kurker of West Newton, Massachusetts for a <br /> Variance from Section 174-32 of the Zoning By-laws to allow the construction of a home <br /> on an unpaved road on property located in an R-3 zoning district at 48 Blue Castle Drive <br /> (Map 104, Block 13)Mashpee, MA. (Owner of record: John G. Bynoe). <br /> Notice was duly given to abutters in accordance with Massachusetts General Laws <br /> Chapter 40A. Notice was given by publication in The Mashpee Enterprise, a newspaper <br /> of general circulation in the Town of Mashpee, on December 23 and December 30, 1994, <br /> a copy of which is attached hereto and made a part hereof. <br /> A Public Hearing was held on the Petition at 7:30 P.M. on Wednesday, January <br /> 11, 1995 at the Mashpee Town Hall at which time the following members of the Board of <br /> Appeals were present and acting throughout: Edward M. Govoni, James E. Regan III and <br /> Robert G. Nelson. <br /> Edward Montero represented the applicant and informed the Board that several <br /> houses had been built on Blue Castle Drive and that the road had been in use for many <br /> years. Comments were received from the Fire Department recommending the installation <br /> of a sprinkler system or the improvement of the road. The Building Inspector informed <br /> the Board that MGL Chapter 40A, Section 3. stated that no zoning ordinance or by-law <br /> could regulate or restrict the interior area of a single family residential building. <br />
