Lapio V-95-8 237 South Sandwich Road <br /> Map 15, Block 11 <br /> A Petition was Sled on December 6, 1994 by Kathryn R. Lapio of Mashpee, <br /> Massachusetts for a Variance from Section 174-25.C.2 to vary the setback requirement of <br /> 150' for buildings housing livestock on property located in an R-5 zoning district at 237 <br /> South Sandwich Road (Map 15, Block 11) Mashpee, MA. (Owner of record: Louis A. <br /> Lapio, TR.). <br /> Notice was duly given to abutters in accordance with Massachusetts General Laws <br /> Chapter 40A. Notice was given by publication in The Mashpee.Enterprise, a newspaper <br /> of general circulation in the Town of Mashpee, on January 6 and January 13, 1995, a copy <br /> of which is attached hereto and made a part hereof. <br /> A Public Hearing was held on the Petition at the Mashpee Town Hall on <br /> Wednesday, January 25, 1995 at which time the following members of the Board of <br /> Appeals were present and acting throughout: Edward M. Govoni, James E. Regan III and <br /> Kenneth E. Marsters. The Petition was taken under advisement and the hearing calendar <br /> extended by mutual consent. <br /> This Decision is issued by the Mashpee Board of Appeals pursuant to the <br /> provisions of Massachusetts General Law, Chapter 40A, Section 9 and Section 174- <br /> 25.C.2 of the Town of Mashpee Zoning By-laws. <br /> Attorney Kevin M. Kirrane represented the applicant and explained that the <br /> property has been used for the raising and training of Arabian horses since the early <br /> 1980's. He reviewed zoning changes and explained that the barn and arena were <br /> constructed on the land for use in the training of the horses. A petition was presented to <br /> the Board from abutters and residents of the area in favor of the Variance. Comments <br /> were also received in opposition. <br />
