Board of Appeals Kathryn R. Lapio V-95-8 3. <br /> Specific FindiM <br /> 1. The Board found that the Applicant requires a Variance from the setback requirements <br /> to legitimate the location of the farm buildings. <br /> 2. The lot is unique from other lots in the said district due to the fact that it is surrounded <br /> on three (3) sides by streets or ways. <br /> 3. A literal enforcement of the By-laws would cause substantial hardship if existing <br /> buildings were required to be removed <br /> 4. The setback requirements relate to this particular property and the shape of the lot <br /> prevents conformance. <br /> The Board found that the residents of the neighborhood and direct abutters were <br /> in support of the Variances and that relief could be granted without detriment to the <br /> public good. <br /> Upon motion duly made and seconded the Board of Appeals voted unanimously on <br /> April 12, 1995 to grant the following Variances: <br /> 1. a Variance of 12' from the 28.3' x 48.2' existing barn to Devonshire Drive <br /> allowing for a 38' setback. <br /> 2. A Variance of 10'6" from the 60' x 100' open arena to Devonshire Drive <br /> allowing for a 30'4" setback from Devonshire Drive and a Variance of 7' from <br /> Warwick Way allowing for a 43' setback. <br /> 3. A Variance of P from the 36'3"x 68'3"barn to South Sandwich Road <br /> allowing for a setback of 49'. <br /> The Variances.are subject to the following conditions: <br /> 1. no more than ten horses may be housed on the property at any one time <br /> 2. the two existing barns or arena cannot be used for living quarters <br /> The Variances are referenced by plans of Weller and Associates revised April 25, <br /> 1994. <br />
