Benway III - V-95-11 <br /> A Petition was filed by George A. Benway III of Mashpee, Massachusetts for a <br /> Variance from Sections 174-31 and 174-32 of the Zoning By-laws to vary the front yard <br /> setback requirements and allow the construction of a single family dwelling on an unpaved <br /> road on property located in an R-5 zoning district at 11 Bay Road (Map 114, Block 36A). <br /> (Owner of record: John and Ann Kelleher). <br /> Notice was duly given to abutters in accordance with Massachusetts General Laws <br /> Chapter 40A. Notice was given by publication in The Mashpee Enterprise, a newspaper <br /> of general circulation in the Town of Mashpee, on January 6 and January 13, 1995, a copy <br /> of which is attached hereto and made a part hereof. <br /> A Public Hearing was held on the Petition at 7:30 P.m. on Wednesday, January 25, <br /> 1995 at the Mashpee Town Hall at which time the following members of the Board of <br /> Appeals were present and acting throughout: Edward M. Govoni, James E. Regan III and <br /> Robert G. Nelson. <br /> Engineer Robert Raymond represented the applicant and reviewed plans for a <br /> proposed house. He explained that the house was sited to have the maximum setback <br /> from the top of the bank and had been approved by the Conservation Commission. He <br /> stated that the Board of Health had approved the septic plans and that a new deed will be <br /> drafted for the sale of the property which includes ownership to the center line of the road. <br /> Mr. Raymond noted that the property will be served by Town water. No comments were <br /> received from abutters. <br />
