Yurek - V-95-16 199 Daniel's Island Road <br /> Map 100, Block 35 <br /> A Petition was filed on January 17, 1995 by Gregory J. and Carol L. Yurek of <br /> Wellesley, Massachusetts for a Variance from Section 174-31 of the Zoning By-laws for <br /> permission to exceed the 70' dock length requirement and to vary the sideline setback to <br /> 10' on property located in an R-3 zoning district at 199 Daniel's Island Road (Map 100, <br /> Block 35) Mashpee, MA. <br /> Notice was duly given to abutters in accordance with Massachusetts General Laws <br /> Chapter 40A. Notice was given by publication in The Mashpee Enterprise, a newspaper <br /> of general circulation in the Town of Mashpee, on January 20 and January 27, 1995, a <br /> copy of which is attached hereto and made a part hereof. <br /> A Public Hearing was held on the Petition at the Mashpee Town Hall on <br /> Wednesday, February 8, 1995 at 7:30 P.M. at which time the following members of the <br /> Board of Appeals were present and acting throughout: Edward M. Govoni, Cheryl A. <br /> Hawver and Kenneth E. Marsters. <br /> This Decision is issued by the Mashpee Board of Appeals pursuant to the <br /> provisions of Massachusetts General Law, Chapter 40A, Section 10 and Section 174- <br /> 25.I.9 and 174-31 of Mashpee Zoning By-laws. <br /> Engineer Michael Grotzke represented the applicants and presented revised plans <br /> for a 96' dock in Popponesset Bay. He explained that the Harbormaster had objected to <br /> the original proposed length of 130'. Richard York, Shellfish Constable, informed the <br /> Board that he had confirmed the water depths on the revised plans and determined that <br /> there would be 2' of water at the end of the dock. <br />
