Joia SP-95-20 49 Somerset Road <br /> Map 16, Block 11 <br /> A Petition was filed on January 11, 1995 by Arthur R. and Darlene E. Joia for a <br /> Special Permit under Section 174-17 of the Zoning By-laws to allow for the relocation of <br /> a garage on property located in an R-5 zoning district at 49 Somerset Road (Map 16, <br /> Block 11) Mashpee, MA. <br /> Notice was duly given to abutters in accordance with Massachusetts General Laws <br /> Chapter 40A. Notice was given by publication in The Mashpee Enterprise, a newspaper <br /> J of general circulation in the Town of Mashpee, on February 3 and February 10, 1995, a <br /> copy of which is attached hereto and made a part hereof. <br /> A Public Hearing was held on the Petition at the Mashpee Town Hall on <br /> Wednesday, February 22, 1995 at which time the following members of the Board of <br /> Appeals were present and acting throughout: Edward M. Govoni, James E. Regan III and <br /> Cheryl A. Hawver. <br /> This Decision is issued by the Mashpee Board of Appeals pursuant to the <br /> provisions of Massachusetts General Law, Chapter 40A, Section 6 and Section 174-17 of <br /> the Town of Mashpee Zoning By-laws. <br /> Attorney Robert Zeida represented the applicant the informed the Board that Mr. <br /> Joia had constructed a garage on land which is now determined to belong to an abutter. <br /> He wanted permission to relocate the garage to his property. The Board stated that they <br /> did not have the authority to act on the relocation but only on the addition of a garage to <br /> the Joia lot. Comments were received from an abutter who had no objection to the <br /> proposed construction of a garage on Mr. Joia's property. <br />
