Realty Trust V-95-21 240 Surf Drive <br /> Map 102, Block 37 <br /> A Petition was filed on January 31, 1995 for a Variance from Section 174-31 of <br /> the Zoning By-laws for permission to vary the setback requirements in an R-3 zoning <br /> district on property located at 240 Surf Drive (Map 102, Block 37)Mashpee, <br /> Massachusetts. (Owner of record: Vincent Porciello). <br /> Notice was duly given to abutters in accordance with Massachusetts General Laws <br /> Chapter 40A. Notice was given by publication in the Mashpee Enterprise, a newspaper of <br /> general circulation in the Town of Mashpee, on February 3 and February 10, 1995, a copy <br /> of which is attached hereto and made a part hereof. <br /> A Public Hearing was held on the Petition at the Mashpee Town Hall on <br /> Wednesday, February 22, 1995 at 7:30 P.M. at which time the following members of the <br /> Board of Appeals were present and acting throughout: Edward M. Govoni, Cheryl A. <br /> Hawver and Kenneth E. Marsters. <br /> This Decision is issued by the Mashpee Board of Appeals pursuant to the <br /> provisions of Massachusetts General Law, Chapter 40A, Section 10 and Section 174-31 <br /> of the Mashpee Zoning By-laws. <br /> Engineer John Slavinsky represented the applicant and explained that the <br /> Conservation Commission had asked that the proposed house be located 50' from the <br /> wetlands in the rear of the property. This resulted in a 25' front setback in an area <br /> requiring 30'. Correspondence was received from the Conservation Commission in <br /> support of the Variance. <br />
