MA 02649 <br /> BOARD OF APPEALS <br /> DECISION FOR A MODIFICATION OF SPECIAL PERMIT <br /> Re: Petition of Dick `n Ellie's Flea Market 650 Falmouth Road <br /> Albert Wiseman, Manager - SP-95-32 Map 81, Block 4 <br /> A Petition was filed on March 8, 1995 by Albert Wiseman, Manager of Dick `n <br /> Ellie's Flea Market for a renewal of Section 4 of the Modification of Special Permit 94-29. <br /> Notice was duly given to abutters in accordance with Massachusetts General Laws <br /> Chapter 40A. Notice was given by publication in The Enterprise, a newspaper of general <br /> circulation in the Town of Mashpee on March 24 and March 31, 1995, a copy of which is <br /> attached hereto and made a part hereof. <br /> A Public Hearing was held on the Petition at the Mashpee Town Hall on <br /> Wednesday, April 12, 1995 at 7:30 P.M. at which time the following members of the <br /> Board of Appeals were present and acting throughout: Edward M. Govoni, Kenneth E. <br /> Marsters and Robert G. Nelson. <br /> Mr. Wiseman represented the Petition and asked that the tent poles be allowed to <br /> remain in place overnight and folding tables stored. He agreed that all merchandise, <br /> equipment and other gear, banners and flags would be removed from the premises daily. <br /> The Board requested that the trailer be moved out of sight and that improvements be <br /> made to the sign light. Mr. Wiseman informed the Board that a second entrance to the <br /> Flea Market from Donna's Lane should improve the traffic flow. <br /> Upon motion duly made and seconded on April 12, 1995 the Mashpee Board of <br /> Appeals voted unanimously to allow the modification of Condition 4. for one year only to <br /> be reviewed before the opening of the 1996 season. The Special Permit is subject to the <br /> following conditions: <br />
