Board of Appeals Deer Crossing Associates SP-95-40 2. <br /> Permit for a proposed 13,000 square foot Building E was granted in 1990 but lapsed <br /> before construction. <br /> He explained that the Applicant seeks to extend the pre-existing non-conforming <br /> use of the property with the construction of an 8,000 square foot Building E in <br /> approximately the same location on Lot 35 which contains 54,993 square feet.. The <br /> building will be located 8 feet from Building D for fire safety considerations and to <br /> provide a separate stairwell to the upper level . He stated that the Applicant had improved <br /> the shopping center with new drains, paving, repainting and landscaping. <br /> Architect Douglas Annino reviewed the proposed landscape and parking plans and <br /> explained that the proposed garden shop fronting on Shellback Way would be screened <br /> with shrubs or fencing and stone walls. The Design Review Committee had approved <br /> preliminary plans for the landscaping. Questions were received from abutters regarding <br /> the pavement and landscaping. The Board reviewed suggestions from the Town Planner <br /> and agreed that some parking spaces could be eliminated and that the radius of the road to <br /> the loading dock be increased. <br /> FINDINGS <br /> General <br /> 1. the subject property is located at 681 Falmouth Road and consists of 54,993 <br /> square feet recorded on Land Court plan 35550E. <br /> 2. the subject property is located in a C-1 zoning district and, with several <br /> adjacent commercial lots, is known as the Deer Crossing Shopping Center. <br /> 3. the Board finds that this is a pre-existing non-conforming use and that the <br /> existing commercial building on the lot does not meet setback requirements <br /> and that a Special Permit was never issued for the commercial buildings in the <br /> shopping center. <br />
