Cooke- V-95-43 49 Ashumet Avenue <br /> Map 41, Block 27 <br /> A Petition was filed on May 1, 1995 by Richard and Jacinth E. Cooke of <br /> Randolph, Massachusetts for a Variance from Section 174-31 of the Zoning By-laws for <br /> permission to vary the side line setback requirement to allow for a house addition on <br /> property located in an R-5 zoning district at 49 Ashumet Avenue (Map 41, Block 27) <br /> Mashpee, Massachusetts. <br /> Notice was duly given to abutters in accordance with Massachusetts General Laws <br /> Chapter 40A. Notice was given by publication in The Mashpee Enterprise, a newspaper <br /> of general circulation in the Town of Mashpee, on June 9 and June 16, 1995, a copy of <br /> which is attached hereto and made a part hereof. <br /> A Public Hearing was held on the Petition at the Mashpee Town Hall on <br /> Wednesday, June 28, 1995 at 7:30 P.M. at which time the following members of the <br /> Board of Appeals were present and acting throughout: Edward M. Govoni, James E. <br /> Regan III and Cheryl A. Hawver. <br /> This Decision is issued by the Mashpee Board of Appeals pursuant to the <br /> provisions of Massachusetts General Law, Chapter 40A, Section 10 and Section 174-31 <br /> of the Mashpee Zoning By-laws. <br /> Mr. Cooke represented his application and informed the Board that he planned to <br /> build a house addition which would result in a sideline setback of 8.8 feet. He explained <br /> that the topography of the lot and the location of the septic system prevented any <br /> alternative sites for the addition. No comments were received from abutters. <br />
